Khalaf & Abuzir File Class Action Complaint Against the Trump Administration

Attorney’s Vivian Khalaf and Omar Abuzir have filed a federal class action complaint on behalf of U.S. Citizen Clients. The lawsuit is targeting President Donald J. Trump, Senator Mitch McConnell, and the Acting Secretary of the Department of Treasury in their Official Capacities. 

The class action complaint has been filed in federal court. A class of U.S Citizens have been denied their COVID-19 stimulus checks because of who they are married to. The suit alleges violations of the individual’s civil rights. Furthermore, the plaintiffs are demanding that the government declare their rightful entitlements under the CARES Act which affords them the equal protection of U.S. laws.

The citizens are entitled to government funding, but have been denied for the reason of being married to non-citizens. The fact that they married a U.S citizen is the reason for not receiving a stimulus check. As citizens of the United States, this is their fundamental right! Moreover, the United States citizens and their U.S. citizen children have been severely impacted by the discriminatory purpose and intent of the CARES Act’s restrictions. To that end, they deserve the full protection of U.S. laws.

So what is the CARES ACT?

The Coronavirus Aid, Relief, and Economic Security (CARES) Act was passed by Congress with bipartisan support and signed into law by President Trump on March 27th, 2020.  The purpose of the CARES ACT was to provide immediate economic assistance for American workers and their families. Furthermore, the Act is suppose to work for ALL AMERICANS. However, this has not been the case. Hence the class action complaint.

The class action complaint is based upon Defendants’ unconstitutional deprivation of the rights, privileges, benefits and /or protections, provided to the United States Citizens, via the enactment and enforcement of the S. 348-Coronavirus Aid, Relief, and Economic Security Act.

As the lead attorney on this case, Khalaf emphasized the biased treatment of U.S. citizens by the government. For instance, if a U.S. citizen filed their tax returns separately, they would be eligible for the stimulus check. But those who filed jointly were excluded because of their mixed family status.
